UK Government Warns Gambling Commission Over Affordability Checks

Meanwhile, the UK government has warned the UK Gambling Commission that any new affordability checks must work alongside the government’s ongoing review of the Gambling Act 2005.

The UK Gambling Commission last year proposed new affordability checks that would require customers to prove their income to operators once they hit a monthly net gambling loss of £100.

As reported by GamblingInsider, the proposal has been met with criticism, with many gambling firms, particularly the British racing industry, claiming they’d lose income from the new affordability checks, which may “discourage” customers from gambling.

The government’s review of the Gambling Act 2005, which launched in December 2020, will look into the Commission’s proposals for affordability checks, as well as analyse the Commission’s power in today’s online age.

Speaking at the Commons, John Whittingdale, the Minister for Gambling and Lotteries who is spearheading the review, said: “We are looking at whether further controls for play online would be effective in preventing gambling harm, including whether greater controls are needed at an account or product level.

“We are also working closely with the Gambling Commission on its parallel work to improve how operators interact with customers and we will ensure that any new checks that they introduce to increase protections for those who are financially vulnerable, binge gambling or losing significant amounts over time harmonise with the aims of our own review.”

Whittingdale added that the Commission is “undergoing a reboot” and that its powers and performance are also being looked at as part of the government’s gambling review.

Ministers are expected to produce a white paper on the review by the end of the year, and a ban on gambling sports sponsorships have already been cited as a “likely” outcome of the review.

Unibet Fined Over Illegal Gambling Advertising

Gambling operator Unibet has been fined AUD$48,000 (Around £25,712) by Liquor & Gaming New South Wales over illegal gambling advertising.

The website was fined for breaching the New South Wales Betting and Racing Act 1998, which states that it is an offence to publish gambling advertisements that encourages people to participate in any gambling activity.

Unibet’s offence dates back to November 2020, when it published three posters of its Uniboost, Reboost, and Uplift special and enhanced odds features to its website and on the Apple App Store.

As reported by iGamingBusiness, Betchoice Corporation Pty, trading as Unibet, plead guilty to three offences during a hearing at the Downing Centre Local Court earlier this month. The operator was fined AUD$16,000 for each offence and was ordered to pay AUD$3,900 in legal costs too.

Darren Duke, the Compliance Director for NSW Liquor & Gaming, said in a statement: “Special or enhanced odds have the ability to induce people to open a betting account when they otherwise may be refraining from gambling and they may encourage people to gamble more frequently.

“During sentencing, the Magistrate noted that Unibet had a record of previous convictions and had most recently been fined $15,000 in 2019 for breaches of the betting legislation. The advertisements were designed to entice people to engage with gambling products and are a breach of legislation.”
